As the result of your overstay for 10 months, you became inadmissible to the United States for 3 years. It means that a U.S. consul cannot give you any visa to the U.S.; and, even if a visa is issued, you will not be admitted at the border. Your brother can file an immigrant petition for you now. USCIS will process it in about 1 year. Then you will have to wait until all the brothers and sisters of the U.S. citizens who filed immigrant petitions before you, get their visas. Only 65000 such visas are given every year, so, right now the visas are being issued to the beneficiaries of the petitions filed in March 2001. By the time your turn comes, your 3-year inadmissibility will be long over.

If you get married to him and you are a US citizen; then he can file for his permanent residence here in the US and would not need to leave the US to apply. There is no monetary penalty and his overstay is forgiven under INA Section 245(a). His brother's case will take about 11 years and he would need to leave the US to apply for an immigrant visa.
