My wife applied for her green card as a dependent but under her own family name(passport). We now have the cards, Can she take my name and how?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
If you wish your wife to take your name under the green card, she can always file form I-90 application for a replacement green card. With most other agencies and institutions, she should be able to use your last name just by presenting the marriage certificate. Your wife is also able to gain a free legal name change as part of the naturalization process if she becomes a US citizen at a later date.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. I got caught shoplifting in USA during B1 and now applying for H1, what possible problems may come up?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
Based on your description, you have a criminal record at least for immigration purposes. You must disclose this conviction in all your applications you make to the US government.? One petty thief crime will not render you inadmissible.? You should be able to apply for H1 or any other visas.

Can my husband sponsor my green card if he has filed the petition for his ex-wife in 2005?

Answered by attorney Peter S Kollory (Unclaimed Profile)
Immigration lawyer at The Law Offices of Peter S. Kollory
The same answer is relevant to both the questions. As long as you have the divorce decree/judgment from the court of competent jurisdiction, he can sponsor you. You do not need to worry about what papers were filed or not for the first spouse as it is not relevant. However, a lawyer has to look at the papers and a personal interview to confirm.
