What are the options for my boyfriend who overstayed his visa and now is in a detention center?

Matthew Ian Bernstein
Answered by attorney Matthew Ian Bernstein (Unclaimed Profile)
Immigration lawyer at Simvisa
Your boyfriend should not allow himself to be deported without a hearing before an immigration judge. He should explain that he would like a bond hearing and a hearing before the immigration judge. He should not sign any paperwork that concedes to deportation. It is very important that he retain the services of an immigration attorney with experience in removal proceedings.

How can our company submit the RFE for H1B?

Read again the RFE letter, it usually contains fairly detailed instructions; if the one you received does not, send your response to the return address in the upper right corner of the letter (next to the USCIS logo). Remember to do a cover letter, clearly referencing the case name and number, and listing all the enclosed documents. Finally, make a copy of the Request for Evidence letter for your file, but send the original back, placing it on the very top of your packet of documents, even over your cover letter - it has to be the first piece of paper the recipient will see.

How do I get a form I130 approved for my husband?

Brian D Lerner
Answered by attorney Brian D Lerner (Unclaimed Profile)
Immigration lawyer at Law Offices of Brian D. Lerner
It is taking far too long. Because you are a US Citizen, you should be able do the I-130 and then the Consulate processing. Alternatively, if you have received a receipt notice, you could do the K3 Petition. *K3 Petition* Since you are already married and your spouse is outside the U.S., it would be necessary to apply for the K-3 Visa. The particular visa is considerably faster than the Consulate Processing needed to bring your spouse in as a Lawful Permanent Resident. Here, we would apply for the K-3 Visa which would take about 6 months. After, your spouse is in the U.S., the Adjustment of Status package can be filed.
