Generally, someone who enters the U.S. lawfully and with inspection such as entering through the visa waiver program - and who then becomes married to a U.S. citizen, may apply to "adjust status" to become a Lawful Permanent Resident (to get a "Green Card"). That process involves filing a Form I-130 Petition for Relative Alien, as well as a Form I-485 Application for Adjustment of Status. Beyond that, the couple must file biographical information forms, the U.S. citizen spouse must file an Affidavit of Support, the couple should file an application for an Employment Authorization Document (an "EAD" or "work permit) - there is no additional filing fee for that, and an application for Advance Parole (a "travel document") if the foreign national spouse is eligible for that. With the applications the couple should file a complete set of supporting documents. The process can be more complex than it first appears, and errors in properly preparing the applications and in fully documenting the applications can result in significant delays or even more harsh consequences. It would be wise to consult with an immigration attorney who, after learning all of the relevant facts about you and your wife, could advise about immigration eligibilities, options and strategies and represent you in the application process. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

The petition who is properly filed with all correct supporting documentation should be adjudicated without any problems within a normal time frame. Attorneys usually know how to prepare good packages, so delays are less common. The USCIS will get to your package in time. If something is missing, the USCIS will send a request for Evidence. Such type of request cause delay. If your package was properly prepared, then it will adjudicated promptly. Good luck.
