Hello, If you entered under the visa waiver program the only manner of remaining in the US is if you are married to a US citizen and they file for adjustment of status for you. Otherwise you would have to leave.  If you overstayed your time over six months you will need a waiver to return to the US for accruing unlawful presence.

How do I file for my husband's marriage based adjustment of status?

The instructions for the I-485 form tell you where to file and how much to pay. You will need to file the I-130 petition at the same time with another fee. The instructions for both forms advise what documents should be included. Make a copy of everything you send.

Should we also send the I-485 as I am in the USA already?

Answered by attorney Lisa E. Battan
Immigration lawyer at Battan Alpert Hutchings LLP
You may want to file the form I-485 now if you intend to apply for permanent residence in the U.S. rather than consular processing abroad. You should consult with a lawyer to understand the difference between consular processing and adjustment of status. You should also carefully consider your travel needs while your adjustment of status application is pending with USCIS.
