Can I apply for my mom's I-485 even though I-130 is still pending?

You should be able to file the I-485 with a copy of the receipt notice for the I-130 OR you can just refile again the I-130 with the I-485 if the first plan doesn't work.

You need to file removal of condition even though late and explain what happened. You need to show extraordinary circumstances beyond your control.

How long does it take to transfer from an F1 visa to a permanent resident?

Reza Athari
Answered by attorney Reza Athari (Unclaimed Profile)
Immigration lawyer at Reza Athari & Associates, PLLC
You will have to continue with your student visa until she becomes a USC or if she files a petition as permanent resident, until priority date becomes current. Remember, F-1 is for people that have the intention to go back to their home country.
