I am H-1B holder & have applied for I-140 thru my employer. I recently married & want to change last name. SSN said I had to change name w/ USCIS 1st.

U.S.C.I.S. recognizes the fact that you can use a spouse’s last name once you marry. That being said, your H-1B approval most likely has the name that you are now using. If you wish the approval sheet to be changed, you would likely have to go through the H-1B amendment process. On the I-140 petition, your employer can attempt to explain to U.S.C.I.S. that you are now married and wish to use your spouse’s last name so that the I-140 petition reflects your desired name. When you file for your I-485 adjustment of status application if adjusting in the U. S. or DS – 260 if consular processing your immigrant visa, you can put in the new name, and your green card will then be spelled in the way that you wish. Unless he is 245i protected, he cannot adjust status in the US. I suggest you file I-130 and I-601A waiver. If the waiver is approved, he can return to his home country to receive immigrant visa if I-130 is also approved. Alternatively, he can file DACA to receive employment authorization and to keep his status in the US. If the relevant immigration law changes, he may be able to adjust status in the US without leaving the US. Your case is not a simple one so please consult immigration lawyer for help.
