The police have the right to test you when they have reason to believe that you are operating a motor vehicle on a public roadway under the influence of alcohol or controlled substances or that your prescription medication is substantially affecting your ability to safely operate a motor vehicle. Just because you have a note offering a possible explanation for your behavior, does not mean this is the case. The police still have the right to conduct their investigation. If you feel you are wrongly charged with a crime, consult with an experienced DUI attorney at once.

In my area the Probation Officers will not request or assist in the modification of the terms of probation. You need to contact your attorney to request the court modify the terms or conditions.
