If officer gives a citation for DUI, doesn't impound car, and lets driver go, can this be used in favor to reduce charges?

There can be a few reasons why the officer did a cite and release as opposed to taking you into custody. The fact that he let you go is helpful...particularly if he let you drive away. Out of curiosity, are you under 21 years old? Also, did you have an instate California drivers license, or an out of state license. You should talk to a DUI attorney about your case in more detail. Sounds like you have the beginnings of a good case to defend.

The new ticket is a violation of probation. More importantly, does your probation prohibit you from drinking? If it does, I would expect the judge to jail you.

We are not sure if my husband has an arrest warrant pending from '06 how can we find out?

If you know which court issued the original charges, call that court and ask if there is a warrant for your husband's arrest. Or hire an attorney to run a warrant search.
