I was just recently in a car accident that my grandbaby was with me and the neither of us were hurt but I passed out driving and wrecked the car

You asked: I was just recently in a car accident that my grandbaby was with me and the neither of us were hurt but I passed out driving and wrecked the carAdditional Details:at the hospital I was drug tested and the police also took blood to send off for drugs, the urine test at the hospital came back that I had cocaine and pcp in my system, I dont know what pcp is let alone take it. I am on several medications and figured that was the reason for me passing out while driving. I am freaking out because now I feel someone has put drugs in my drink or something, now I will be charged for dwi, child endangerment and dwls. My family wants nothing to do with me and now child protective services wont allow me to see my children or grandson, I am on cymbalta, xanax, vistiril, tramadol, zocor and as I have read on several places on the internet, some of these meds make you pass out and I have lost my family over this and would like to know what and who I can turn too to prove my innocence. I take the meds I am perscribed and I am bi polar and need them, I dont like my seroquel xr but do take it, please help me if you can.also seroquel Jennifer, You are charged with serious crimes, and need a lawyer.  If you are unable to hire your own attorney, then the Court will appoint one to represent you.  If you claim that you did not take cocaine or pcp, then your attorney will explore whether there was an error in the testing, and whether your other medications could cause a false positive reading.  You should also have an attorney for the Probate Court matters.  If CPS will not let you see your children, then it is likely that a petition alleging abuse and neglect has been filed against you.  YOu have a right to hire an attorney, or have an attorney appointed to represent you .  Stu Shafer

Can I get a DUI ticket if no field test or toxicology test were given?

Steven H. Fagan
Answered by attorney Steven H. Fagan (Unclaimed Profile)
DUI/DWI lawyer at Fagan, Fagan & Davis
You certainly can be charged if the officer believes his investigation has revealed sufficient facts to support probable cause to arrest. Whether the charges hold up to scrutiny by a skilled and experienced DUI lawyer is another matter entirely, and you should seek out the best lawyer you can.

Will I get remanded if I got an OWI, am out on a bond, had to move to another state and I haven’t had my first court date?

default-avatar
Answered by attorney James S Lawrence (Unclaimed Profile)
DUI/DWI lawyer at James S. Lawrence
The purpose of bond is to assure that the defendant will show up for court. The judge gave you bond, but you did not show up. Most judges would substantially raise your bond, or deny it altogether, if you are brought back to court. However, if you turn yourself in back at the court that placed you on bond, it is at least possible that the judge would give you another bond, since you did ultimately show up. However, since you are broke and unemployed, you might not be able to pay the bond even if the judge sets one. I recommend that if this happens again, you show up for court, even if you have major financial issues. In all states I am familiar with, you will not be able to get a valid license until this OWI charge is resolved. If you are now unemployed, this would perhaps be a good time to come in and take your medicine, which may very well include some jail time, and then look for a job when you get out. If you get a job now, and are suddenly arrested on this OWI, that might cause you to lose your job for not being able to show up for work. An unemployed person, not hospitalized or in jail, will have a tough time convincing a judge that he was too busy to show up.
