If you are under 21, you are likely to be prosecuted for driving with a blood alcohol concentration of .01 or above. If you are over 21 you may still be prosecuted for DUI but not for being .08 or above, in California there are two charges, driving under the influence which is prosecuted based on your driving, officer observations and field test performance and .08 or above which is based on the chemical test. In your case, you shouldn't be prosecuted for being .08 or above but may be prosecuted for driving under the influence. You should meet with a DUI attorney to discuss the possible outcomes based on the facts you present.

You are represented and so you need to talk to your attorney about these concerns and issues. PD are very good attorneys. They are in court all the time and know the prosecutors and Judges very well. There is no reason to freak out. Just because your prosecutor is taking a hard line on your case and not reducing or dismissing it doesn't mean your attorney isn't working hard for you. Sometimes things just need to be tried.

It may get dismissed, but they can charge you. They probably can't convict you with out driving. If the DA files charges you WILL need a DUI defense lawyer to help you fight it.
