Theoretically, they would have to prove that you were driving. If the truck was parked at or near the bar you were at and there are witnesses who can testify that you were in the bar shortly before the police arrived, it would be a difficult case for the D.A. to prove. Of course, they will probably try.

In California, DUIs remain on your DMV record for 10 years and cannot be expunged from your DMV record. The DUI convictions may be expunged from the court records, at the discretion of a judge, but can still be used as enhancements for future DUI filings and convictions. In addition, you cannot expunge your DUI until after you have completed probation. However, you may be able to file a motion with the court for early termination of probation. I suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

A 0.032 BAC is well below the limit for a DUI. Depending on the results of the blood test, you should not have received a DUI. There also may issues as to why you had to take a blood test after taking the breath test. I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.
