If you are arrested for DUI does an officer have to read you your rights?

Answered by attorney Philip Daniel Hache
DUI/DWI lawyer at Law Offices of Phil Hache
This is a common question. If you were never read your Miranda rights, it is possible to suppress statements made after you were arrested. This does not necessarily mean that you can beat the case, but it can be helpful.

Possibly, however, your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. What was your BAC on the last DUI. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.

Does a weekend count as 3 days served in jail?

Answered by attorney Mark K. Rosenfeld (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Mark Rosenfeld
Maybe. Some judges will give good time work time credit for a weekend. Need more information to answer the question. If you are looking for credit for a 2nd time DUI with 96 hours of jail... you must do the actual time, 96 hours.
