The issue is if either you were driving in a manner to show that you were under the influence or if you were driving with .08% or more alcohol in your blood. Each are separate charges and either would have the same punishment.

Unfortunately, the best defense in a situation like this is that someone else drove you there and left trying to find gas. The other option is that you drank at the scene where you were stopped, empty bottles or cans would help. Fine is close to $2,000. There is a minimum of 2 days jail, DUI school, at least 3 years probation and this will be a prior conviction for 10 years if you are charged with another DUI. Of course, your insurance will rise also.

You will have to go to court and get the bench warrant recalled. That should get your license back. If it doesn't, then it's because you didn't do the class. If you live in another state you can get DMV to issue 1650 waiver.
