Yes, if you were not the driver you have a defense. A DUI attorney in your area can likely help you with this defense and provide counsel regarding how to put it on and whether or not you will need to be acquitted by a jury or if the prosecutor may dismiss the action. It will help if the actual driver comes forward and admits to being the driver, of course that person will then be facing possible hit and run charges.

The DMV process is completely different than the court process. If her blood alcohol level was over the legal limit, she needs to request a DMV hearing within 10 days of the arrest. If she loses the hearing, she will need an SR-22, proof of enrollment in the applicable class and payment of a reissuance fee to get a restricted license. Regardless of whether criminal charges have been (or will be) filed.
