If I blew a .000 am I required to submit to the blood test after passing the Breathalyzer?

Answered by attorney Patrick Owen Earl
DUI/DWI lawyer at Patrick O. Earl
Usually if the officer suspects drugs in play instead of alcohol he will have the person submit to a blood test only. If there is a question a BAC test can be ran (or a baby one called a PBT) and then when it comes out to be .000 then he will go through the inplied contest warnings for blood. Yes, if the officer has enough probable cause to ask you to submit to a blood test and you refuse it, that refusal can be used against you in court. So you would need to submit to the blood test.

Will a judge allow me to attend DUI classes or a DUI charge that happened years ago or will I be facing jail time?

Answered by attorney John F Brennan (Unclaimed Profile)
DUI/DWI lawyer at Musilli Brennan Associates, PLLC
I would hope that the judge would take the current situation into consideration and allow you to complete your classes and list the warrant for your arrest. In order to accomplish that I believe that you should engage in attorney to try to prep the situation at the least risk to you.

If the DUI charge is reduced to reckless driving, should the accused include it in a job application as crime conviction?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
Reckless driving is actually a traffic offense. So, your son can include it if he wants because it is a conviction, but he can also not include it because it is not a crime.
