Can a cop ask me to drive after he has already stopped me and knows that I had been drinking?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Probably, but it seems to me that by asking you to drive he is admitting that he didnt think you were under the influence or unsafe to drive. You should consult a DUI attorney, these facts are obviously helpful to the defense and may result in your case being dismissed or reduced.

Is it possible for my daughter-in-law to be brought after a blood test?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
I'm not sure what your question is, but if your daughter-in-law was arrested for DUI, pursuant to implied consent she provided a sample of her blood. The results of the analysis will provide evidence of her drug use...or not. Either way the blood will be an important component of the prosecutor's decision whether to prosecute the case.

What will happen after receiving your second DUI 7 months from your first DUI?

Answered by attorney Joshua James Price
DUI/DWI lawyer at Defending Rights Law Center
Depending upon what jurisdiction he is in, he could be looking at between 4 days to one year in jail. However, many jurisdictions offer alternatives to jail to where he would not be behind bars. Many factors play a role in these offenses and more information would need to be known. Contact a local attorney.
