Will I have to serve jail time for my first DUI?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
If convicted in Utah, you are required to have 2 days in jail, but it could be longer. Hire a talented attorney and you may avoid a conviction.

Possibly. I would need to know more of the specific facts, but there is a possibility that you had your 4th amendment rights violated. You should contact a criminal defense lawyer to discuss this matter in detail.

Is it possible to get my license back sooner after I complete alcohol rehabilitation? It is my first DUI and everything like fines and stuff.

Answered by attorney Joseph Briscoe Dane (Unclaimed Profile)

Assuming you are over 21 and this is a first DUI conviction: Your license is suspended for 6 months. You can get a restricted license after 30 days of no driving if you are enrolled in the alcohol program, have a current SR-22 and pay a re-issue fee to the DMV. You can get your license fully reinstated after you complete the alcohol program and after the six months.
