You have a bench warrant for DUI AND a DUI charge. So, you need to turn yourself in on the DUI bench warrant. After you sit in jail for 2-3 months, you get to go to court and fight the DUI. Your license is now suspended on failure to appear in court. After you clear that up, you will lose your license for DUI conviction.

If the alcohol container is open the person can be arrested, but would probably be only be given a citation to appear in court. It is against the law to ride in a vehicle and consume alcohol. It is illegal to ride in a vehicle with open alcohol containers.
