The accident made it a felony. The BA is over twice the legal limit, making enhanced penalties mandatory. When charged with any crime, the proper questions are, can any evidence obtained in a test, search or statement be used against you, can you be convicted, and what can you do. While this isn't a 'capital case', it certainly carries potential jail, so handle it right. No amount of free 'tips and hints' from here or elsewhere are going to effectively help in a legal defense. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. I'll be happy to help fight and get the best outcome possible, using whatever defenses and sympathies there may be.

You don't NEED one. Will it help? YES! Especially if the arrest was recent. In a DUI arrest, you only have 10 calendar days to preserve your right to a DMV hearing. Without that hearing, the DMV will automatically suspend your license based on the arrest. An attorney can request that hearing for you at the appropriate DMV Driver Safety office and will be able to subpoena evidence and any witnesses necessary to competently defend your license. If you want any chance at maintaining your license, you should at least consult with a couple of attorneys about your case. DMV hearings, just like Court hearings, can be very complicated and involve many technical defenses when it comes to DUI charges.

The fact that he was stopped or outside the car when the police stopped him and arrested him is irrelevant... if he was observed to have been driving. He is also in physical control of the vehicle. You do not say that you were driving, so I suspect that means that your husband was. As far as what will happen to your car. You will not loose it as a result of the arrest.
