Should I have refused the breathalyzer test when I was pulled over?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
Colorado has an implied consent to a chemical test law in Colorado Revised Statute 42-1301.01. This requires you to submit to either a blood alcohol test or breath alcohol test upon request of an officer who has probable cause to arrest you for driving under the influence of alcohol. If you refuse the evidentiary test, the DMV could suspend your license for a year. During a DUI stop, you are not required to submit to the field sobriety tests and you do not have to answer any of the officer's questions. If the officer believes that he/she has sufficient probable cause to believe you are under the influence of alcohol, then you must submit to a chemical test.

DUI/DWI lawyer at Austin Legal Services, PLC
Miranda warnings only apply to incriminating statements, not the validity of the arrest. A Miranda violation will never by itself get a case dismissed, it will only suppress incriminating statements made while in police custody. Police only have to read your Miranda warnings when they wish to interrogate you are ask you incriminating questions, not every time they arrest you. Jared C. Austin, Attorney-at-Law

Can I get a DUI program referral from a county other than the one where I got my DUI? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
Your best bet is to consult the lawyer who represented you on the DUI. Failing that, check with the clerk of court in the county where you were convicted about making a new referral. Good Luck. (O by the way, drink if you wish, but don't drive afterwards. It's not worth the trouble ad expense.)
