What are we looking at as far as punishment for a DUI probation violation?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
It sounds like your fiance has nearly completed everything. Keep that up. The new charges are probation violations. Getting them fixed the right way will solve the probation violation. For example, if charged with Driving Under Suspension, but only convicted of speeding or some other lesser charge, then likely no prob revo. Also, if fiance pleads guilty to a moving violation when he was suspended, it suspends him for a year even if the DUS is not a conviction. Beware.

If I was arrested for DUI and reckless driving was I suppose to have my Miranda rights read to me?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
DUI/DWI lawyer at Francis John Cowhig
Although an officer should read you your Miranda rights when you are arrested, it is not absolutely necessary as long as you are not questioned about the crime for which you were arrested or were detained during the questioning. Miranda only acts to suppress any statements you gave the police after you are arrested or detained. It does not invalidate an arrest.

Will I have jail time for a possible charge for driving while suspended?

Answered by attorney Philip Daniel Hache
DUI/DWI lawyer at Law Offices of Phil Hache
Yes. If you have a VC 14601.2 charge (license was suspended based on DUI), even a first offense conviction has mandatory jail time. Speak to a DUI/criminal defense attorney in your area who can help mitigate damages, and possibly get the charge dismissed or reduced.
