How will previous DUI charges affect my current DUI charge?

default-avatar
Answered by attorney Steven M Dodge (Unclaimed Profile)
DUI/DWI lawyer at The Law Office of Steven M. Dodge, PLLC
A prior offense will mean that your maximum penalty will increase from 93 days in jail to one year in jail. You are much more likely to face time in jail on a second offense. Also, you will face a license revocation rather than merely a suspension. The fines and costs also increase. It's time to get an attorney. Write if you have other questions.

Is it legal for me to drive in one state with a DUI in another state?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
Did you attend court on the scheduled dates? If not, there may be a warrant out for you. Have a lawyer check on whether or not this is so, and make arrangements for you to make a court appearance and have the warrant vacated. You definitely need a capable lawyer who might be able to straighten things out. Do not just ignore this issue, because it will not die, and it will very likely come back sometime in the future to trouble you. If the court entered judgment against you on your non-appearance, it probably did suspend your licence. A suspension in one State is a suspension in every State. Therefore it is unwise for you to drive until after this is all straightened out. If you must drive, even if it is a bad idea, then be 100% certain to obey every single traffic law, so that you are not stopped by an officer, who will almost certainly check your record.

Can you still be charged with DUI when you’re not in the car or keys or found behind the wheel?

Answered by attorney Philip Daniel Hache
DUI/DWI lawyer at Law Offices of Phil Hache
It is possible that they can charge you with a DUI even though they didn't witness driving. But based on what you wrote, your case has many potential defenses. Lack of observed driving, the fact that the case is three years old and they are just now pressing charges (that is potentially a huge issue for the prosecutors). You should speak with a DUI Attorney in your area as soon as possible to get a more specific assessment of your case.
