How can an officer say my breath test was .10 when I didn't take one?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
Two questions. First, you were not driving and given DUI. Second, you were not given breath test and .10 was placed on the paperwork. Is that right? Not that you think there were no witnesses to you being behind the wheel and you blew in the alcosensor but not the machine at the jail. You cannot represent yourself, IF you do not know what is going on.

What will happen if I missed my court date for not having a license but I got the license back now?

DUI/DWI lawyer at Francis John Cowhig
If you missed your court date, there is probably a bench warrant issued for your arrest. You will need to clear this with the court and have your case re-set for hearing. The fact that you now have a license will work in your favor.

Are there two different tests for drugs and alcohol?

Answered by attorney Lawrence Lewis (Unclaimed Profile)

Everyone always talks about something feeling strange after they have chronically abused marijuana, drove pot head friends around in a mechanically defective vehicle, reeked of alcohol and struck fixed objects. What are you waiting to hear/read? Demand a jury trial, and see IF the prosecutor can put the case together. IF he/she cannot, all of the charges will be dismissed. IF the prosecutor can put the case together, then you will see all of the evidence as it is presented to the jury, and you will not have anymore questions about the evidence. In the meantime, retain an attorney that knows what to do.
