How can I file for divorce if I cannot locate ex who has been gone for 12 years?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)

If you have diligently attempted to find your spouse you can ask the court to let you run the notice by publication. If it is granted, you will run a notice in a specified news paper one time for four weeks. If your missing spouse does not respond you move forward with the divorce through default.

Generally, all property (including retirement) accrued during marriage is equally divided upon divorce. Also review the Child Custody, Child Support, and Spousal Support and Alimony pages. You should consult with expert family law counsel.

No. You are separated, he can date anyone he wants, and he can choose to lack discretion. The only issue in which indiscretion may have a bearing is in a custody dispute. Absent that, your best bet is to block his account and move on.
