Do I have to move out of my daughter's house. I am there by invitation of my daughter who is going through a divorce. House jointly owned.

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
You have as much right to be in the house as your Daughter's guest as your daughter has.  During the divorce resolution, the house may have to be sold, or the asset divided, but there is noreason you have to leave the house unless there is some final resolution changing ownership of the house.

What is my recourse for paying child support and alimony if she does not reside with the children?

Answered by attorney Stuart Jon Bierman (Unclaimed Profile)
Divorce lawyer at The Law Offices of Stuart Jon Bierman
Seems like you should contact an attorney and arrange to file a motion with a Judge to get some assistance from the court. The Judge should be made aware of this situation so he or she can make some changes in the status quo that would be in the best interests of the children. For example, if the child support money is not going to the grandparents for the benefit of the children but instead is being used for the benefit of the mother then a Judge would want to know about it.

Can I force the sale of our house if it was awarded to my husband during our divorce settlement?

default-avatar
Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
If he was given the house in the divorce you can't force a sale. Check your divorce papers to see if there's anything you can do if he's late. If the loans Changed check to see if he took your name off it. Doesn't make sense to have your name on the new loan without your signature If you are not on the new loan he shouldn't be able to affect your credit. Check to make sure you are off the HOA.
