If I was served with a divorce complaint over 90 days ago and nothing has happened, do I need to refile?

If you haven't answered yet, you need to do so right away. Anytime after 30 days and until you file the Answer, you are not involved in the case and she can file a Default against you and ask the Judge to make orders based on your ex's requests (you wouldn't be involved because you never Answered the Petition). Once you answer, then you will get notice of everything going on in the case. If you want the Judge to make orders (for child support, visitation, spousal support, etc), you will need to file a Request for Orders after you file your answer. If you and your spouse cannot agree on all issues (children, support, division of assets and debts) and file a Stipulated Judgment, then you will need to have a Trial to finalize your divorce and receive final orders on all issues. The case will not move forward unless one or both of you file the necessary paperwork to make it move forward.

The paperwork is available online or through publishers like NOLO press. My guess is this is not really about "the paperwork" but about your "standing" (a legal term basically meaning the law recognizes you have sufficient interest in the case to allow you to be heard). I would think based on you having had actual physical custody for 4 years that you should be able to establish sufficient relationship to allow you to be heard by the Court, but it is certainly possible the Court ruled against such a finding since you say the court won't allow you to participate. You need to talk to a good custody attorney.

A portion of both your retirement benefits and his retirement benefits, that you each accrued during the time of the marriage, even if that period was only 2 years. Those portions will be figured into the total community estate when it comes time to divide between the two of you. Since you each have interests, they may well match and cancel one another out, preventing either of you from having to pay the other one.
