Can my wife take me to court for child support if the child is not mine?

Answered by attorney Vanessa J. Gorden
Divorce lawyer at GordenLaw, LLC
You will need to have the paternity tests in hand to declare the child not yours, as technically you are the legal father for being married to the mother when the child was conceived. However, since she has gone after the biological father now for child support, you should be able to extract yourself from this situation. You will need a good lawyer.

If a marriage is over and there are chilren involved, if the father moves out, will he lose parental rights to his children/

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
Moving out of the house is not going to be cause for denying someone parental rights.  The father will still have to be financially responsible for the children and will be eligible for visitation.

The children can be registered in school where the parent who has residential custody lives.  If you are living in Tenafly, and have custody of the kids, you can register them in Tenafly schools.  Where you live in New Jersey is up to you, you will not be restricted from living anywhere within New Jersey.
