Under certain circumstances, a prenup might protect you from his creditors. To be effective against creditors, however, you or your husband must provide them with a copy of the prenup, or otherwise be certain they know of its existence at the time the debt is incurred. Otherwise, the prenup might be valid as between you and your husband, but would not likely be valid against creditors. Of course, if the debts arose before the date of the marriage, you are not liable on them.

Yes you can either in a pending divorce case or one that has been settled by re-opening it. If you are not talking about a divorce situation, you can file a complaint in civil court to force a division of the property by sale. You will need a lawyer on this kind of issue.
