Can I file for divorce on the grounds of myself committing adultery?

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
Thank you for your question.  The only reason you might file under adultery is to meet the requirements because there is no time requirement under adultery, as opposed to the six months irreconcilable differences must exists as a grounds for divorce, but you or your spouse will need to provide an affidavit attesting that one of you is a New Jersey resident at the time of the filing. Please keep in mind that you would have to prove the grounds for adultery. However, you must separate the grounds from divorce from the jurisdiction requirement that you are a resident of the state for at least 12 months. I suggest you consult an experienced attorney to further discuss this.

Can someone serve you with divorce papers in a courtroom..

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
You could ask the sheriff's officers or process servers to do that.  Tell the company you have hired that the person will be in court and the date, and they will serve it.   You can't just hand the documents to the person, you have to have some record that the person received the documents.  the sheriff's officer can bring the documents to the judge, and the judge would be able to provide the documents, and make a record that the documents are being handed to your spouse.

How can you keep a soon to be ex-husband's girlfriend away from your children?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
You would have to show that she creates a risk of harm to your children. If you cannot, there is no valid reason for her to be kept away from your children.
