It is legal to record a conversation to which you are a party. it is not legal to use her passwords to access her phone or e-mails. It is almost always stupid to try to prove that someone is an unfit mother because of alleged affairs.

No. Generally, you need his permission or a court order. If the kids have been in New York for more than 6 months, than New York has jurisdiction over the kids. If you move without permission or a court order, your husband can get a court order and in some cases a warrant for your arrest. He may be able to force you back here and it could result in an immediate change in custody (giving him the kids and you get visitation). The court doesn't look lightly on this sort of thing. Be sure you talk with a lawyer before you proceed. Good luck.
