All property acquired during marriage, unless by gift or inheritance (to you alone) is community property. Therefore, if your wife requests it, there will need to be an evaluation made of the worth of the business. If the asset (the business in your case) was acquired during the marriage, then it's entire value will be used, and she will be entitled to 50% of your share in the business. If the asset was acquired before the marriage, she will be entitled to 50% of the increase in value to your share of the business from the date of marriage to the date of separation. Usually, a financial expert will be needed to place a current value on the business (and a value at date of marriage, if necessary).

To give you lawyer-like answer, that depends. If you have never lived in Oregon, for instance if you and your spouse separated and he or she moved to Oregon, stayed here for six months and then filed the dissolution, the Oregon court would only have jurisdiction to grant the dissolution but would not have jurisdiction to allocate marital property or award spousal support. (If you have kids that the other spouse brought to Oregon for that six-month period, the court would also have the authority to award custody but not parenting time or child support under the UCCJEA.) On the other hand, if you used to live in Oregon with the spouse that filed the dissolution, the Oregon court would likely have jurisdiction over all aspects of a normal dissolution including child custody (if the kids stayed in Oregon), parenting time, child support, spousal support and the division of marital property (but other factors can come into play on this issue). You really need to consult with a lawyer who is licensed in Oregon to explore the jurisdictional issues. If you are in California, you can contact the State Bar referral service to find a lawyer who is licensed in both states.
