Is filing taxes together considered common law marriage?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
An informal marriage requires 1) an understanding between the parties they intend to be married, 2) living together, 3) holding themselves out to the public as being married. Filing joint tax returns as married and other acts such as joint bank accounts, using married names, etc. are indications of #3. I suggest you hire a lawyer.

I filed for a default on March 11, 2013 what do I need to do next?

Anthony O. Van Johnson
Answered by attorney Anthony O. Van Johnson (Unclaimed Profile)
Divorce lawyer at Anthony Overton Van Johnson Associates, P.C.
You really did not provide any details about your legal matter. So, I am left with making an assumption that you are referring to a divorce action. Nevertheless, any time you file a civil action and the Defendant fails to file any responsive pleadings, you can proceed with your case and present your evidence. At this point, the Defendant is left with only arguing as to the amount of the damages you are alleging. Typically, in a divorce action, if no responsive pleadings are filed, the case can be resolved on an uncontested calendar. Since you failed to present any facts, you should consult with an attorney to provide the necessary details about your legal matter.

Am I entitled to half of the money from the sale of the house if my husband sells it?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
If it was left to your husband as an inheritance it is his separate property and you are not entitled to any of it (unless the community paid down the mortgage or for improvements).
