How can my brother get his soon to be ex wife to leave?

Answered by attorney Marcia J. Mavrides
Divorce lawyer at Mavrides Law
If your brother wants to force his wife to leave the marital residence, then he must file for divorce and file a motion to vacate. He will also have to file an affidavit to support his motion to vacate and show there are compelling reasons supporting his request that she be vacated from the marital residence. Also, unless he is an owner of the property or lessee, then she could argue that he should be the one to leave. Your brother should consult an attorney to review his options.

My husband is divorced from former wife and she is remarried, I am his present wife, can he change the beneficiary on IRA?

default-avatar
Answered by attorney Dana A. Azar (Unclaimed Profile)
Divorce lawyer at Law Offices of Dana A. Azar
It is necessary to review the divorce decree before this question can be answered. If the divorce decree gives the ex-wife any right to the IRA, then the ex is entitled to what the decree gives her. If the divorce decree does not grant her any interest in the IRA, then your husband is free to make you the beneficiary.

Can the husband still continue to pay for insurance?

default-avatar
Answered by attorney Jon Laurence Rathjen (Unclaimed Profile)
Divorce lawyer at Law Office of Jon Rathjen
It would depend on whether the court retained jurisdiction over spousal support. If it did, she could argue the cost of coverage constituted a material change in circumstance justifying a modification.
