To get a divorce under No Fault grounds (irretrievable breakdown) you need to have a breakdown in the marriage for at least 6 months. This means if you want a No Fault divorce, you will need to wait 5 months. If you want to start the process now, you could instead claim "cruel and inhuman treatment" as your reason for the divorce, as there is no time requirement for those grounds. Talk to a lawyer about your situation. Good luck.

It's not clear what you had signed, but the only person who signs a Judgment of Divorce is a judge. There is no "decree" in New York law.

What can I do if the house in the divorce is not in my name? How?

Answered by attorney Vanessa J. Gorden
Divorce lawyer at GordenLaw, LLC
Nebraska is a community property state and thus, it does not matter whose name the home is titled in - if it was purchased during the marriage and paid down with marital monies, it is a marital asset to be divided in your divorce. You should at least consult with a family law attorney who can confidentially discuss the details of your specific situation with you and advise you on your options.
