Would traditional court divorce or mediation be better for my divorce?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)
Divorce lawyer at Landon Rainwater Robinson LLP
You might consider a collaborative divorce. You both hire collaborative attorneys but everything is handled out of court similar to mediation but you have an attorney where in mediation you do not. With your husbands practice/income you would want to bring in a neutral accountant to determine all the income and debts. If either of you drop out of the collaborative process you whould have to hire NEW attorneys to litigate the case in court. However, if you do not feel like your husband would cooperate with disclosing assets or financial information you should consider hiring a good family law attorney who will be able to get the information.

What is the best way to divide assets with my husband?

Find an attorney mediator to help you settle your case and divide your assets pursuant to the law. You will probably have to pay him some spousal support if he's not working.

What can I do to get a fair divorce?

You can contact an attorney or mediator to assist you in bringing your case to a final judgment so you can get remarried. You can work with a self help clinic to file the initial paperwork and have your wife served. Then the clock is ticking and your case will live forward from there.
