I filed for divorce in nj but husband remarried in dominican republic....what can be done

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
If your husband married someone else without first being divorced from you, he committed bigamy, which is a criminal offense.  Even if you and your husband have been separated for some time, if you have not received a Judgment of Divorce, he is still your husband and entitled to benefits as your husband, including, but not limited to, a share in your estate should you pass away before he does, social security benefits and others.  A divorce ensures your rights and interests are protected going forward.  The attorneys at Weinberger Law Group are experienced in representing clients through sensitive issues like yours and through divorce.  We are happy to assist you and make the divorce process as smooth as possible.  The attorneys at Weinberger Law Group offer a free initial consultation and can speak with you about your rights and options.  Call today (855-548-2157) to schedule your free initial consultation.

Should I proceed to file my taxes separate.

Answered by attorney Elena Weitz
Divorce lawyer at Elena Weitz (Principal at OffitKurman)
You are still legally married so you can file Married-filing Jointly or Married-filing Separately. You should consult with your accountant as to whether which filing results in a larger refund, or lower amount owed, and then discuss with your spouse which way is best to file and how the refund/amount owed will be split between the two of you. If you and your spouse are not on good enough terms to work this out yourself than I suggest you consult with a divorce attorney and the attorneys can work this issue out. Either way you should start considering consulting with and restating a divorce attorney to represent you in your divorce.

What can happen if my spouse refuses to give me a divorce?

Cassandra T Savoy
Answered by attorney Cassandra T Savoy (Unclaimed Profile)
Divorce lawyer at Cassandra T. Savoy, PC
Your spouse can not refuse to divorce you. Once you file, and your spouse is properly served, the court considers the divorce all but a done deal. The court then turns its focus to the orderly division of the parties assets and liabilities, and to that which is in the best interest of their children.
