She has to be divorced first. If she wants you she will find her husband and file for divorce or get a default judgment. She can find a family law attorney in the Philippines to help her. This will take time.

Being in the home means that you can ensure that your home remains in good shape and market-ready should you decide to sell as part of the divorce. It can also save you money over paying rent. However, when living apart is best, you will want to get all agreements about the house in writing. What is best for you will depend on the individual factors on your situation. You may be in trouble. You hired a lawyer and presumably agreed to his hourly fees. That was a contract, if it was in writing he could charge over $1,000. Your payments may be considered to have kept the claim open all these years. It does not seem fair, but you are obligated to pay. If you fail to pay I would hope that they would not come after you for the additional amounts due to your health and financial problems.
