I have a house I made my husband sign a prenaupt and I am retired, will I receive alimony based on infidelity?

Answered by attorney Diana L. Anderson

If you made your husband sign a prenuptial agreement did you sign one also?  Did you mutally agree that you would not seek alimony?  If you did, then the prenuptial agreement would govern.  however, if the agreement is limited to him not having an interest in your house, then you might be able to get alimony.

I owned my condo prior to marriage, we lived in the condo for 5 years, we are now getting divorced, my spouse was nvr on mortgage or deed.

You have to look at what's equitable distribution.  You speak of liability for the mortgage.  What about the proceeds of the sale?  Is there equity in the property or does the value of the mortgage exceed the value of the property?  Usually, she might be entitled to the appreciation in the value of the property, but the recent drop in property values means that there is possibly no appreciation anyway, just liability for the mortgage.  If that's the case, the mortgage debt, or a portion of it, might be part of the overall settlement.

What can I do if my husband from overseas refuses to sign the divorce papers?

Cassandra T Savoy
Answered by attorney Cassandra T Savoy (Unclaimed Profile)
Divorce lawyer at Cassandra T. Savoy, PC
The NJ courts do not require one to sign for a divorce. The courts only require that the person receive a copy of the summons and complaint. That is why the summons and complaint are usually delivered by an independent third party. There are rules regarding how to effect service abroad.
