Is there a law or rule in NJ that no one is allowed to sell marital property or use marital assets during the divorce?

Richard Scott Diamond
Answered by attorney Richard Scott Diamond (Unclaimed Profile)
Divorce lawyer at Diamond & Diamond, P.A.
If you are going through a divorce and your spouse is / has sold off assets of the marriage without your consent, you need to consider filing an application with the court for sanctions against him / her. As part of your application, if you beleive that he did so, to try and prevent you from sharing in it or with the plan to re-acquire it at a later date, you need to present all of your proofs now so that a judge can address it and potentially hold your spouse accountable for its value, etc in the divorce or to compel its return.

Do all assets become half owned by your spouse after marriage?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
Generally speaking, assets owned prior to marriage remain separate property (unless the assets are later "commingled" by adding the spouse's name to the title). Assets acquired during the marriage are presumed to be community property. If you and your future spouse wish to have greater control over how assets are designated, you may want to consider entering into a prenuptial agreement.

How do I protect myself during a marriage seperation?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
You should close any account that is a joint account and open your own accounts, in your own name now, to establish your credit.  If your husband took cash advances, make it clear that payment on those cash advances comes from him from the beginning. Ask to have the credit cards on which the cash advances were taken put into his name alone to protect yourself.  Make sure to obtain copies of the statements showing the cash advances, and if possible, have him acknowledge that the cash advances went to him.  Good Luck !
