You may want to discuss the pros and cons of filing separately with a tax consultant. With regard to the fact that your spouse does not wish to divorce and does not wish to pay spousal support.  What matters is not what he wishes to do or not do, but what the courts rule based on your specific situation.   First, if you wish to divorce, you can divorce since CA is a no fault state and you do not have to find fault in order to divorce.  Second, you have had a long marriage and there are certain laws in place with regard to spousal support.  The courts look at the length of marriage, what each party earns, the education & health of both parties and need as well as other factors.  Based on the facts, the courts will decide whether spousal support is warranted and for how long.

Since only case case requests a divorce you should proceed with your action. If the court's want to consolidate the two cases it will do that at some point. In many cases the two spouses will agree in writing to consolidate the two cases and have each other's petition deemed a response to the other Petition. This could save each of you filing fees in the other case.

You question is confusing. Why would want to "annul" a divorce? If your ex- was married when he married you, your marriage to him was legally invalid. But, if you didn't know that and 12 years later you got a divorce instead of having the marriage declared invalid, it would not seem to make much difference now. There might be a procedure to have the divorce order cancelled, but that might create more, new issues.
