The courts do not provide counseling for parties, they will only provide mediation for child custody disputes. Your wife is under no obligation to attend counseling with you before seeking a Judgment of Dissolution.

There are no free, court appointed lawyers for divorce cases. It may be possible that a judge might make you pay a portion of her attorney fees if you make substantially more than she does, but she would initially be responsible for her finding and retaining her own attorney.

Double check to make sure that common law marriage is acknowledged in Colorado. Lots of people think they have a common law marriage but really they don't. If the marriage was valid, file a petition for dissolution of marriage and ask the court to enter the judgment on that divorce for a date that is earlier than the date you married your current husband. This is done a lot. It is called entering a judgment "nunc pro tunc" which means "now for then".
