The duration of the marriage; (ii) The age of the parties; (iii) The health of the parties, including their physical, mental and emotional condition; (iv) The standard of living established during the marriage; (v) The relative income and earning capacity of the parties, recognizing that the wage earner's continuing income may be a basis for support distinct from the income that the supported spouse may receive from the distribution of marital property; (vi) A party's training and employment skills; (vii) A party's work experience; (viii) The financial needs and resources of each party; (ix) The tax consequences to each party; (x) A party's custodial and child support responsibilities; and (xi) Any other factors the court deems just and equitable.

If you are truly doing an uncontested divorce, go to the court and pick up the documents called a pro se packet. You can do that all yourself, and you will only pay the filing fees.  If you need assistance , call my office.

Thank you for your question. Generally speaking, upon divorce a spouse is entitled to half of the “marital coverture” of any retirement plans. This means the income added to the plan from the date of marriage to the date of complaint. Each plan can be a little different in their rules, and pensions are tricky because they are defined benefit plans, not defined contribution plans like 401(k)s. When the tie comes to split any retirement assets, lawyers will consult or engage an actuary. During the negotiation phase of a divorce, parties are allowed to agree that one person gets a larger share of the equity in the home, or some other asset, in exchange for waiving rights to the pension.  You have options, but the best course of action is to consult with an experienced matrimonial attorney, who can advise you based on your unique situation.
