Can I legally removed my ex husband at this point on my health insurance?

default-avatar
Answered by attorney Vicki S. Vasser (Unclaimed Profile)
Divorce lawyer at Wright, Lindsey & Jennings LLP
Once a divorce is final, typically one can use the decree of divorce to remove a former spouse from a group health insurance. Typically, employer-related health insurance coverage would NOT extend to someone who is not a dependent (ex-spouse). There are occasions when a decree of divorce may obligate a former spouse to pay for private health insurance or to assist the former spouse in obtaining COBRA coverage, but typically the former spouse would not be eligible for the identical coverage the former spouse enjoyed while married to you.

Can I purchase a home during divorce?

default-avatar
Answered by attorney Jessica M Cotter (Unclaimed Profile)
Divorce lawyer at The Law Firm of Jessica M. Cotter, P.L.L.C.
Yes there is, or at least there may be. In Arizona your soon to be ex can sign a community property disclaimer deed, indicating that although you remain married this new house will be your separate property. You should speak with your attorney about this, and also verify with the company that will issue your title insurance that they will accept the disclaimer deed.

What am I entitled to if the house is in both our names?

Answered by attorney Vanessa J. Gorden
Divorce lawyer at GordenLaw, LLC
Yes, the house belongs to both of you. Visit with a lawyer about how this will work. Generally, one of you will receive the house in a divorce or legal separation. Any mortgage or debt against the house will be assigned as well. If there is equity there, the person receiving the house may owe the other party to "buy them out" of their interest. An attorney can help you understand this process fully.
