How can I protect my 401K during a divorce? Also would it still be protected if I roll it over to an IRA?

Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
If the 401k account is considered marital property (i.e. some or all of it accrued during the marriage), there is nothing you can do to "protect it" from being considered in an over all property settlement and rolling it over to anything won't change that fact.

Since we are still married and I have sole physical custody can he really stop me from going on vacation with my son?

Answered by attorney Anita Alice Webster (Unclaimed Profile)
Divorce lawyer at Law Offices of Webster & Associates
Generally you can travel out of state for a vacation as long as you are not removing the child for purposes of permanently taking the child out of the jurisdiction. You should provide an itinerary of the inclusive dates of travel, address and telephone where you can be reached. If you have an attorney discuss this with your attorney first.

What are the procedures on getting an annulment under six months?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
The length of the marriage has nothing to do with whether you can seek an annulment. A marriage can only be annulled if there was a legal flaw at the time the marriage was entered into. If the marriage was validly entered into, and then a change in circumstances causes you to no longer want to be married, then you would have to seek a divorce, not an annulment. Since Arizona is a no-fault state, the reason for the divorce (e.g. infidelity) is irrelevant.
