How does one go about finalizing a divorce?

Annette M Cox Sandoval
Answered by attorney Annette M Cox Sandoval (Unclaimed Profile)
Divorce lawyer at Cox Sandoval Law, PLLC
If one party will not consent to a divorce, then the other party can file a "motion to set trial." The judge can then enter orders finalizing the divorce of the couple at the time of trial, even without the consent of the reluctant party.

Is there anything else I need to do since I wasn't able to file the Judgment Package until after the 6 month mark?

Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
If I understand your question, you are asking if the 6 month mark is a deadline to get your divorce finalized. In California, the 6 month mark is the MINIMUM required time to finalize your Dissolution of Marriage. The court will not finalize the divorce until 6 months and one day after the other party was served with the Summons and Petition, you may file your paperwork before the 6 months, but it won't be finalized until after that date. You may also file your paperwork after 6 months and it will be finalized immediately because you are already past your minimum 6 month waiting period.

Am I required to share W-2 after divorce?

default-avatar
Answered by attorney Robert Andrew Michael Burns (Unclaimed Profile)
Divorce lawyer at Law Office of Robert Burns
Unless there is an order or some discovery device requiring you to do so, you need not do so but you may regret not doing so. If you are paying Smith-Ostler extraordinary support without an accounting you can expect a more costly process to require you to provide the accounting which would seemingly involved W-2 information. My guess is that she doubts that you are turning over all bonus checks.
