Colorado no longer provides for an annulment. Instead, there is a proceeding to obtain a Declaration of Invalidity when there are legitimate reasons why the marriage should never have occurred. Attempting to explain that law in this forum is not practical, but it is far more restrictive than what most people think an annulment means. The law has very strict limits and time deadlines so you will need to contact an attorney to discuss the reasons you think the marriage should be declared invalid. However, second thoughts or simply deciding you made a mistake is not enough and you probably need to pursue a divorce - not an invalidity declaration. In either situation, however, your home would be considered your separate property and the only possible claim the husband could assert would be to a share of any increase in value that occurred during the marriage. In today's poor economy it would be almost miraculous if your house increased in value during the 4 months you have been married.
