  Unfortunately, no.  The law of Florida is that a marriage is not valid if one of the parties has a legal spouse at the time of the marriage. See Jones v. Jones, 119 Fla. 824, 161 So. 836 (1935).  Thus, even though your prior wife has died, she was alive at the time you married in 2008.     Therefore, your best bet at this juncture is to now "legally" marry the lady you've called your wife since 2008.  I don't think, however, you should request additional gifts from family and friends this time!    Best of luck, Cindy Vova Law Office of CIndy S. The issue is how was the house paid for. If it was owned outright prior to marriage, then it is your husband's separate property and you likely have no interest in it. If he was making payments on it during marriage, then the community acquires an interest as part of the principal reduction payments and you are entitled to 50% of the community interest. You may also be eligible for spousal support.
