What are my rights if I get a divorce after 10 years of marriage?

Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
If you are in Florida, you are entitled to half of whatever assets were acquired during the marriage, including his 401k. If he added your name to the deed, then the house would be half yours as well. As for child support and alimony, you would most likely be entitled to both; however, the determination of specific numbers would require much more information and will depend on many factors. You should consult with an attorney.

What can I do if every time I request to proceed with the divorce my ex throws many accusations to overwhelm me and my past attorney?

Divorce lawyer at R. Jason de Groot, P.A.
First of all stop being overwhelmed by what she says or does. There are legal ways to deal with things like this, but you have to have an attorney on your side. Find someone who will accept payments, and who has practiced for decades.

Can I garnish my ex-husband’s social security savings due to his defaulting on court ordered alimony never paid to me?

Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
Generally, the language of your final judgment of divorce and/or any settlement agreement made a part of it will affect the remedies available to you. In many situations, you may need to file a motion for contempt and enforcement of your final judgment and/or agreement. In some instances, you may already possess what you need to have your alimony deducted from his wages or benefits, if an Income Withholding Order or Income Deduction Order were entered at the time of your divorce. Even so, it may still be a better idea to proceed with a motion to have the full amount of the arrears established by the court, and obtain an award of interest for the unpaid arrears, and possibly obtain an increase in the payment so that a portion can be applied to the arrears, on top of the ongoing alimony obligation. Consult with a family law attorney for assistance.
