No, the same lawyer cannot represent both of you. However, if you have entered into an agreement, then you may not need a lawyer any longer if the negotiation of the agreement has been concluded, and it has been typed up, reviewed by your attorney, and signed by everyone. Once an agreement has been fully negotiated, typed and signed by everyone, your case can be scheduled for an uncontested final hearing and your spouse and their lawyer can appear without you. It may also be possible for you to attend the final hearing by telephone, but you'll need to check with the judge's assistant if they will allow it. Consult with an attorney to discuss the specifics of your situation and your options.

She would have to be a resident of Florida for 6 months before a divorce can be filed here. It can be done. The filing fee is over $400, and a reasonable fee for an uncontested divorce.

The proper thing to do would be to file the petition for dissolution prior to selling or disposing of assets. You do not have to wait to see if divorce papers have been filed, you can file on your own behalf and it does not require your husbands consent or approval. Hopefully there is nothing going on like "hide the assets".  I would be concerned if you were expecting a divorce to be filed, and instead nothing is happening for 6 months and you suspect that real property and cars are being sold.  You should consult with an attorney right away.  The act of filing for divorce is important because it sets the "date of filing" which is the date at which time marital assets and debts are valued. Any assets or debts incurred prior to the date of filing are marital, and subject to division by the court. Any assets or debts incurred after the date of filing are normally non-marital and not subject to division by the court.  The court has discretion to "look back" and see if either party disposed of assets just before the divorce filing however.
